1. Acceptance of Terms
By accessing or using Beat Archivist ("the Game"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Game.
2. Description of Service
Beat Archivist is a free-to-play music trivia game where players arrange songs in chronological order. The Game offers multiple modes including Endless Mode, Daily Challenge, and Family Mode for multiplayer gameplay.
3. User Conduct
You agree not to:
- Use the Game for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Game or servers
- Use automated systems or bots to play the Game
- Impersonate other users or entities
- Use offensive, inappropriate, or harmful nicknames in multiplayer modes
4. Intellectual Property
The Game, including its design, code, graphics, and content (excluding third-party music and album artwork), is owned by Charles Point Dev. Song metadata, album artwork, and music playback are provided through the Spotify API and remain the property of their respective owners.
You may not copy, modify, distribute, or create derivative works based on the Game without our express written permission.
5. Third-Party Services
The Game integrates with Spotify for music playback and metadata. Your use of Spotify features is subject to Spotify's own Terms of Service. We are not responsible for Spotify's service availability or any issues arising from Spotify integration.
6. Disclaimer of Warranties
The Game is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the Game will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the fullest extent permitted by law, Charles Point Dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Game.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Game. Your continued use of the Game after changes constitutes acceptance of the new Terms.
9. Termination
We reserve the right to terminate or suspend your access to the Game at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
